Terms of Service

You must be at least 18 years old to submit an application, purchase tickets, or attend the event. By using the site you represent that you meet this requirement and that any information you provide is accurate and complete.

Designer, sponsor, press, and practitioner applications are reviewed by the Company in its sole discretion. Submission does not guarantee acceptance. Credentials are non-transferable and may be revoked at any time for violation of these Terms or event policies.

All ticket sales, sponsorship fees, and application fees are final and non-refundable except where required by Florida law. We may reschedule, relocate, or cancel any portion of the event for reasons including weather, force majeure, or public-safety considerations. In the event of cancellation by the Company, your sole remedy is the refund options offered at that time.

We are committed to a safe, respectful environment. Harassment, discrimination, intoxication that endangers others, weapons, unauthorized solicitation, and unauthorized commercial filming are prohibited. The Company may remove any attendee who violates these policies without refund.

Attendance at runway, wellness, fitness, and beachfront programming carries inherent risk of injury. By attending, you voluntarily assume all such risks and release the Company, the National Hotel Miami Beach, sponsors, and their respective affiliates from liability for personal injury, illness, or property loss to the maximum extent permitted by Florida law.

The marks WORLD OF WELLNESS™, SWIM & ACTIVE FASHION WEEK™, and THE DEITY SHOWS™, together with the site’s photography, video, copy, and design, are owned by the Company or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent. Designer and partner materials remain the property of their respective owners and are used with permission.

By entering the event you grant the Company an irrevocable, royalty-free, worldwide license to capture and use your name, voice, image, and likeness in any media for promotional, editorial, and archival purposes connected to the Company and its sponsors.

When you submit an application, portfolio, headshot, video, or other content, you grant the Company a non-exclusive license to use those materials to evaluate your submission and to promote the event. You represent that you own or are authorized to share the materials.

The site and event are provided “as is” and “as available.” To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by Florida law, the Company’s aggregate liability arising out of or related to these Terms, the site, or the event shall not exceed the greater of (a) the total amount you paid to the Company in the twelve months prior to the claim, or (b) one hundred U.S. dollars (US$100). The Company is not liable for indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold harmless the Company, S.A.F.E. Group, the National Hotel Miami Beach, sponsors, and their respective officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms or your conduct at the event.

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the event shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to personal jurisdiction and venue in those courts.

The parties will first attempt to resolve any dispute informally for at least thirty (30) days. If unresolved, disputes (other than claims for injunctive relief involving intellectual property) shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Miami, Florida, before a single arbitrator. The Federal Arbitration Act governs the interpretation and enforcement of this provision. Class actions and class-wide arbitration are waived to the extent permitted by law.

We may update these Terms from time to time. The “Effective” date above reflects the latest revision. Material changes will be posted on this page; your continued use of the site or attendance at the event constitutes acceptance of the updated Terms.
